On the territory of the Lviv geriatric boarding house, during the inventory, a building was “found” in the register, which in fact does not exist. So the management of the boarding house turned to the law enforcement officers.
The position of the city is that 14 hectares of land of the geriatric boarding house should be used only for the needs of its residents.
“On October 18, concrete blocks appeared in this area. We took them on our own and decided to fight on our own. On November 2, a manipulator came here, who was supposed to bring the blocks again and pour the foundation, but he did not succeed.
It costs us health, but it’s okay, we fight. With the help of the regional and city councils, we defend this land. We do this for our residents: the elderly and people with disabilities. We already have plans, we want to have a rehabilitation center here for our people with disabilities, after all, our boys are also fighting, they will also need rehabilitation after they return,” says Eteri Pasek, head of the Lviv Geriatric Boarding House.
The manager of the boarding house immediately informed about the latest events on the territory of the facility, and the Lviv City Council on the same day directed the specialists of the Department of State Control over Land Use to inspect the site and record that there is no property of a public organization here.
“The territory of the geriatric boarding house is 14 hectares. The position of the Lviv City Council is that this entire area is definitely the territory of a geriatric boarding house and there can be no discussions. Although it is true that in 2010, by order of the head of the Lviv regional state administration, a decision was made to transfer 2.4 hectares of the total area of the land plot of the boarding house to the charity fund “Active mercy”. After that, there were many very different legal and judicial vicissitudes and they continue to this day.
The position of the city is clear and understandable – this plot of communal property, which is formally in the use of a charitable foundation, can be used exclusively for the needs of a geriatric boarding house. This is a joint position of both the city and the region. We will take all possible legal measures to fully settle this issue and secure the land for the geriatric boarding house,” said Lyubomyr Zubach, Lviv’s deputy mayor for urban planning.
Since 2009, as a result of court proceedings, it was possible to defend the fact that this land is communal, but the court still left the plot of 2.4 hectares for the use of the charity fund. Therefore, the Lviv City Council is now preparing a resolution that will secure the entire land for a geriatric boarding house. The city will also file a lawsuit in court to cancel ownership of the non-existent building.
“Now we have registered criminal proceedings, investigative actions are ongoing. In total, at one time, there were 4 trials with different subpoena requirements. Both the Lviv City Council and the Prosecutor’s Office filed lawsuits challenging the 2009 order of the head of the Lviv Regional State Administration.
We are now waiting for the Lviv City Council to adopt the relevant resolution, including taking into account these circumstances, new legal proceedings will be initiated regarding the unfinished construction,” said Yaroslav Hasyak, head of the legal department of the Lviv Regional Council.
According to Lyubomir Zubach, the city council was previously approached with a request to develop a detailed plan of the territory and change the zoning, but the city did not support such a decision.
“Today there is zone G-5, zone of medical facilities. We made sure that there was no urban planning documentation that would allow residential construction. Not so long ago, a year or two ago, there was an appeal to the city council to open a detailed plan of the territories in order to change the zoning here, but we said that this is impossible,” Lyubomyr Zubach emphasized.
It should be noted that 292 people currently live in a geriatric boarding house in Lviv, of which 45 are internally displaced persons. 70 residents of the geriatric boarding house are bedridden.
