
The construction amnesty of 2015 became an important step towards resolving issues related to unauthorized construction in Ukraine.
Construction amnesty is a legislative mechanism that allows citizens to legalize real estate objects built without appropriate permits. The 2015 amnesty was introduced to simplify the procedure for legalizing unauthorized constructions and to minimize administrative barriers. The main aim of the amnesty is to protect the property rights of real estate owners, bring the property into the legal framework, stimulate the registration of real estate to avoid legal disputes in the future.
The construction amnesty of 2015 applies to the following objects: individual (estate) residential houses, garden, and dacha houses with a total area of up to 500 square meters, as well as household (backyard) buildings and structures with a total area of up to 500 square meters, built in the period from August 5, 1992, to April 9, 2015; agricultural buildings and structures built before March 12, 2011. Importantly, the amnesty does not extend to objects constructed on lands not intended for the respective type of construction or on plots that violate environmental or urban planning norms.
To process the construction amnesty, the owner (or an authorized person) needs to submit the following documents to the local body of state architectural and construction control at the location of such an object through the center for administrative services or via the electronic cabinet using the software of the Unified State Web Portal of electronic services “Diya Portal”: an application for the legalization of the object, a document confirming ownership or use of the land plot, a technical passport made by a certified technical inventory specialist, a technical inspection report of the object (if the area exceeds 500 sq.m.), confirming compliance of the structure with building norms.
The construction amnesty offers several key advantages: the owner obtains full rights to dispose of their property, avoidance of legal disputes or fines in the future, the possibility to connect to engineering communications (electricity, water, gas).
