The prosecutor’s office carries out systematic work aimed at protecting and preserving water fund lands, preventing their destruction, illegal change of purpose, and withdrawal from state ownership.
In 2024, prosecutors in the Lviv region filed 18 lawsuits to return 740 hectares of water fund land to state ownership. Already, 7 claims have been satisfied and a court decision has been issued to return 350 hectares in favour of the state.
Prosecutors also uncover facts of sale of water fund land as land of other categories and numerous cases of use of water fund land, reservoirs and other water bodies without concluding land lease agreements and without paying any money for their use or in violation of the terms of lease agreements.
The court upheld a claim filed by the regional prosecutor’s office against a private enterprise to return a 70-hectare water fund land plot with a reservoir located on it. It was established that the company had been using the land and the reservoir for business activities and profit, in the absence of documents granting the right to such use and without paying the relevant payments to the budget.
The court also upheld a similar claim for the return of a water fund land plot with a reservoir of more than 130 hectares in favour of the Yavoriv territorial community.
Equal attention is paid to the legality of the use of coastal protection strips and compliance with the regimes of economic activity on such land plots.
In particular, illegal ploughing of water fund lands and commercial agricultural production on such lands were detected. In order to eliminate the identified violations, the prosecutor’s office filed three lawsuits to remove obstacles to the use and disposal of water fund lands with an area of more than 36 hectares. All the claims have now been satisfied by the court, and the prosecutor’s office is taking steps to enforce them.
Protecting the state’s interests in water fund land is one of the priorities of the prosecutor’s office. Work in this area is ongoing.
