The Lviv District Administrative Court supported the principled position of the Specialized Environmental Prosecutor’s Office of the Lviv Regional Prosecutor’s Office and preserved the landscape reserve of local importance.
By its decision, the court refused the auto-garage cooperatives to satisfy the claims for annulment of the decision of the Lviv Regional Council on the declaration of a nature reserve of local importance.
It was established that in 2019, the regional council decided to create a landscape reserve. We are talking about a unique object of the nature reserve fund with the largest deposits of peat in the Lviv region with an area of 92 hectares.
However, in 2020, the Ryasne-Ruska village council made an illegal decision to transfer to the above-mentioned cooperatives the private ownership of five plots of land located on the territory of the nature reserve fund with an area of more than 15 hectares.
Accordingly, garage cooperatives received the land on the territory of the reserve after the creation of the reserve itself.
The prosecutor’s office appealed to the court due to the illegal privatization of land, and part of the plots have already been returned to communal ownership.
However, the cooperatives decided to challenge the creation of the reserve itself in court.
In order to protect the interests of the state, the prosecutor’s office entered the case.
The court considered the case and refused the applicants to satisfy the claim. According to the results of the adopted decision, the reserve will not be built up with private garages and will be preserved within the approved limits.
