The court recognized as lawful the dismantling of the temporary structure on the square. Halytskyi in Lviv, which prevented the reconstruction of the fountain and public space

The Eighth Administrative Court of Appeal confirmed the executive committee’s compliance with the notification and dismantling procedure of the temporary structure at 10 Halytskyi Square, which the entrepreneur tried to appeal. This was reported by the head of the legal department, Helena Payonkevich.

In September 2021, a kiosk was dismantled on Halytskyi Square, which interfered with the reconstruction of the fountain and public space and was removed from the prospective scheme of temporary structures back in December 2019. The entrepreneur had time to pick up the pavilion on his own, but did not do so, so a decision was made to forcibly dismantle it.

“The validity period of the temporary construction passport on the square. Halytskyi, 10 has ended. The owner refused to dismantle it. Colleagues successfully dismantled this structure on the basis of the decision of the executive committee dated 09/18/2020 No. 828. The district administration has created a public space at this place.

The owner of the building appealed the decision of the executive committee. The decision of the court of first instance was rendered in favor of the plaintiff.

However, the Eighth Administrative Court of Appeal satisfied our appeal and found that the executive committee followed the procedure for notification and dismantling of the temporary structure, provided for by the current legislation and resolutions of the Lviv City Council,” said the director of the legal department of the LMR, Helena Payonkevych, on her Facebook page.
