A 23-year-old man was found guilty of illegal acquisition and possession for the purpose of sale of narcotic drugs and psychotropic substances in particularly large quantities (parts 2, 3 of article 307 of the Criminal Code of Ukraine) in the court of appeals after a public indictment by the prosecutors of the Lviv regional prosecutor’s office.
Previously, by the decision of the district court, the defendant was sentenced to 5 years behind bars with confiscation of property.
However, the prosecutors did not agree with this position and filed an appeal, but the appellate court left the sentence unchanged. Prosecutors later appealed this decision to the Supreme Court. The latter canceled the appeal decision and ordered a new trial.
Prosecutors proved that the convict intended to sell cannabis and PVP in the form of bookmarks in Lviv.
He received the coordinates of the location of narcotic drugs and psychotropic substances via Telegram, which he then packed into bundles at his place of residence.
Law enforcement officers detained a man during the regular receipt of such “goods” in a specified place.
Taking into account all the circumstances, the Lviv Court of Appeal sentenced the man to a new sentence of 9 years of imprisonment.
