State registrar to be tried for illegally increasing the area of an apartment at the expense of another in the same building
Prosecutors of the Frankivsk District Prosecutor’s Office in Lviv have sent an indictment to court against the state registrar of one of the city councils in Lviv region. He is charged with unauthorised alteration of information processed in automated systems or stored on the carriers of such information, committed by a person who has the right to access it and abuse of authority (part 1 of Article 362, part 3 of Article 365-2 of the Criminal Code of Ukraine).
The investigation established that in 2022, the state registrar, with the aim of obtaining illegal benefits, illegally registered the ownership of an apartment for a Lviv resident.
To do this, he made unauthorised changes to the State Register of Real Property Rights on the basis of forged documents. In particular, the notice and the Technical Passport did not correspond to the title documents for the apartment in terms of the area of the object. The defendant failed to verify the authenticity of the documents provided to him and illegally increased the total and living space of the apartment at the expense of another apartment in the building. To conceal his unlawful actions, he made an illegal decision to cancel the registration for the other apartment.
As a result of such actions, the real estate was unlawfully withdrawn from the ownership of the rightful owner. Its estimated value is over UAH 350 thousand.
The pre-trial investigation was carried out by investigators of the Main Department No. 1 of the Lviv Region Main Department of the National Police with the operational support of the Migration Police Department of the Main Department of the National Police in Lviv Region.
Note: In accordance with Art. 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
