As a result of the official’s illegal actions during the illegal transfer of land plots from communal to private ownership, the state suffered losses in the amount of about UAH three million.
The offender was exposed by operatives of the SBU Office in Lviv region jointly with the Lviv Police Investigation Department under the supervision of the Lviv Regional Prosecutor’s Office.
According to law enforcement officers, in 2020, the head of one of the village councils of Yavoriv district, abusing her official position and intending to illegally transfer three land plots with a total area of almost one hectare and a total value of about three million hryvnias to the ownership of the village residents, approved the relevant decisions of the village council, which led to the illegal transfer of these plots to private ownership.
At the same time, the head knew that at the time she made these decisions, the village council had already been included in the Lviv UTC, and therefore the decision to approve the land management project and transfer these land plots should have been made at the relevant sessions of the Lviv City Council.
The pre-trial investigation in the criminal proceedings initiated under Part 1 and Part 2 of Article 364 (Abuse of power or official position) of the Criminal Code of Ukraine and Part 1 of Article 366 (Forgery) of the Criminal Code has been completed. The indictment was sent to the court for consideration.
The maximum penalty facing the accused is imprisonment for up to six years with disqualification to hold certain positions or engage in certain activities for up to three years, with a fine of five hundred to one thousand tax-free minimum incomes.
