Due to the principled position of the prosecutors of the regional prosecutor’s office, the appellate court revoked the decision of the first instance court without change. The decision of the remaining Lviv resident was found guilty of the facts of illegal preparation, storage and storage of especially dangerous narcotic drugs, illegal accessory, preparation and storage of possessions intended for the preparation of narcotic drugs, and also organizing a place for the illegal production of narcotic drugs (part. 2 Article 307, Part 3 Article 313, Part 2 Article 317 CC of Ukraine).
It was inserted that in one of the apartments in the Sykhivsky district of the city of Lvov, a makeshift drug laboratory was condemned.
For this person, we need to establish a unique environment, create a customized microclimate and grow hemp plants. This year, as the plant ripened, it was cultivated, resulting in the production of a particularly dangerous narcotic substance, cannabis. After packing this, it was distributed locally to drug addicts.
The defendant was involved in a drug scam and then photographed the scene and at the same time used the coordinates of the location to “clients” on Telegram. After that, I took it off for a price.
At the first instance, the accused was found guilty and sentenced to punishment – 5 days of release.
However, the party did not agree with the request and filed an appeal, in which it asked to change the type of punishment imposed by the court, but we will not rule.
Having heard the parties and the prosecutor’s arguments, the appellate court supported the position of the prosecutor’s office. The court deprived the court of the first instance of its decisions without changes, and the appellate side without satisfaction.
