On October 12, 2023, the administrative board of the Western interregional territorial branch of the Antimonopoly Committee of Ukraine established the existence of a conspiracy between the limited liability company “Trading House “Loza” and the limited liability company “Production-project association “Fix” during their preparation and participation in tenders .
It is about the purchase of services for the current repair of street furniture (benches) in the pedestrian zone of the central part of Lviv, which was ordered in 2021 by the Halytsky District Administration of the Lviv City Council.
The department found out that the defendants coordinated their actions during the preparation and participation in the auction, as evidenced by a number of discovered evidence. In this regard, the administrative board of the Western MTV recognized the actions of TD “Loza” LLC and VPO “Fix” LLC as a violation of the legislation on the protection of economic competition in the form of anti-competitive concerted actions that led to the distortion of bidding results.
A fine of UAH 68,000 was imposed on LLP “TD Loza” and LLP “VPO “Fix” for conspiracy.
According to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for anti-competitive concerted actions related to the distortion of tender results during the last three years.
