The Mayor of Lviv, Andriy Sadovy, informed the deputy business ombudsman, Tetiana Korotka, about the situation around the architectural monument at 12 Svobody Ave., where the “Vienna Cafe” is located. He emphasized that the owners have significant comments regarding the violation of monument protection legislation.
So, in 2006, in the building at 12 Svoboda Avenue, the previously existing veranda-gallery with an open terrace on the roof of the building was rebuilt. Later, in 2007-2008, this terrace, without any permits, turned into a room with a roof. Later, the owners separated this (already two-story) premises and registered it as a separate real estate object at another address – pl. Pidkovy, 2. Without the approval of the cultural heritage protection authorities, the summer site of the coffee shop is also located.
“The city department for the protection of the historical environment sent a prescription to the Viennese Coffee Shop LLC with the requirement to dismantle arbitrarily installed structures in the architectural monument of local importance. The owner did not fulfill the requirements of the order and contested it in court, where the only argument of the illegality of the order was the fact of assigning a separate postal address to the terrace, i.e. removing this part of the landmark building from the scope of the Law of Ukraine “On the Protection of Cultural Heritage”. Such arbitrary actions of “Vienna Cafe” LLP are evidence of unscrupulous misconduct of the owner of the architectural monument,” says the letter that Mayor Andriy Sadovy sent to the deputy business ombudsman Tetiana Korotkii.
Therefore, on August 30, 2022, the executive committee of the city council made a decision instructing the specialized departments of the city council and “Vienna Coffee House” LLP to jointly develop the concept of facade solutions for the “Vienna Coffee House” building
“The decision of the executive committee is mandatory for implementation on the territory of the Lviv MTG and was not contested by the representatives of Vienna Coffee Shop LLC.” The owner showed willingness to work together on the concept and restore the historical look of the building.
For our part, we will make every effort to settle the dispute and hope for your support for the community’s actions to protect the cultural heritage of the city of Lviv,” Mayor Andriy Sadovy emphasized in his address.

The house consists of three floors and an attached veranda. Until 2006, the veranda was in the form of an open terrace, and later, in 2007-2008, this terrace turned into a room with a roof. The entrepreneurs carried out the reconstruction of the building without permits, there was no project for a closed terrace. For unknown reasons, after construction, entrepreneurs separated the terrace into a separate real estate object, which received a different address.
The protection agreement and the current legislation of Ukraine impose clear obligations on the owner of the cultural heritage monument regarding the maintenance of the building and the territory around the architectural monument.
