Resolution No. 775 of the Cabinet of Ministers of Ukraine dated 14.07.2023 “Some issues of implementing the rights of victims of accidents at work and occupational diseases to receive social services” entered into force. What does the new document provide and what are the changes?
Social services in two directions
In order to take into account the individual needs of people who suffered as a result of an accident at work and an occupational disease, the state provided them with reimbursement of the costs of social services in two main directions:
care at home;
natural aid
Care at home
As before, the victim at work independently chooses the method of obtaining social care services at home: either by concluding a contract with a person (legal / physical) who provides such services, or by paying monthly monetary compensation for the provision of social care services at home by a family member ( another person).
At the same time, the list of types of social services for which compensation is provided in the case of care at home by a family member (another person) has been expanded. From now on, if the need is determined, the victim, in addition to the compensation for the provision of permanent outside care, is provided with a monthly compensation for the provision of special medical care and household services.
Amounts of monthly monetary compensation:
– minimum wage, if the need for special medical care is determined (6,700 UAH);
– half of the minimum wage, if the need for permanent outside care is determined (3,350 hryvnias);
– a quarter of the minimum wage, if the need for household services is determined (1,675 hryvnias).
The need for a specific type of care is determined by:
the conclusion of the medical and advisory commission (MCC),
and/or a medical report on the ability to self-care and the need for external assistance,
and/or an extract from the inspection report of the medical and social expert commission (MSEK) (reference to such inspection report),
and/or an individual rehabilitation program for a person with a disability (IPR) (if it is completed).

If the victim is determined to be in need of special medical care, permanent outside care and household services, monthly compensation for each of them can be provided at the same time.
Natural help
Victims of industrial accidents and occupational diseases can be compensated monthly for the cost of sanitary and hygiene products, food, clothing, shoes and other basic necessities.
Compensation is provided as part of the minimum wage, depending on the type of in-kind assistance, based on a list of measures determined by the social manager after an examination.
At the same time, compensation can be provided for all specified means at the same time.
Who determines the need for the provision of social services
Assessment of the needs of the victims, information about which was transferred by the bodies of the Pension Fund of Ukraine to the authorized bodies of local authorities, is carried out by a social manager/social work specialist/social worker, who draws up an act of assessment of the needs of the family/person (according to the approved form), taking into account the information specified in the conclusion of the LKK and/or the medical opinion about the ability to self-care and the need for outside help, and/or an extract from the MSEK inspection report (references to such inspection report), and/or in the IPR (if it is drawn up) and fills in the list of measures for calculation in the amount of monthly monetary compensation for the cost of measures necessary to provide the social service of in-kind assistance to the victim.

The social service of care at home and the social service of in-kind care can be provided at the same time.
