Head of State-Owned Enterprise Accused of Abuse of Office

Prosecutors from the Lviv Regional Prosecutor’s Office have sent an indictment to the court against the head of one of the state-owned enterprises. He is charged with abuse of office (Part 2, Article 364 of the Criminal Code of Ukraine).

Illegal Lease of Real Estate

The investigation established that in 2023, the accused, abusing his office, organized the illegal lease of real estate to a private educational institution. Specifically, without holding an auction by the regional State Property Fund and at a reduced usage fee rate for property that belongs to state ownership.

For this, the man drafted, signed, and sealed with the seal of the state-owned enterprise he headed a \”favorable\” Preliminary Agreement on the use of individually specified real estate with the entity. According to this agreement, the educational institution paid only 30% of the rental fee from the total calculated amount determined by the property valuation. However, the accused knew that the rental fee is determined by auction results, and that 70% of the total calculated rental fee is paid to the budget.

Damages to the State Budget

As a result, the State Budget of Ukraine suffered more than 5 million UAH in damages. In order to compensate for the aforementioned material damage, a civil lawsuit has been filed within the criminal proceedings. The trial is ongoing.

The pre-trial investigation was conducted by detectives of the Territorial Department of the Bureau of Economic Security in Lviv region, with operational support from the Security Service of Ukraine in Lviv region.

Note: According to Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until proven guilty in a lawful manner and established by a court’s conviction.
