The Western Commercial Court of Appeal overturned the decision of the first instance and upheld the claim of the Stryi District Prosecutor’s Office. The court ruling invalidated the land lease agreement and ordered the land to be returned to the local community.
This is a plot of land with a total area of more than 44 hectares and a water body of more than 35 hectares. It is located within the boundaries of the Stryi city territorial community.
It was established that a land plot with a pond for fishery needs was illegally leased to a citizen on a non-competitive basis in connection with the acquisition of ownership of real estate. In particular, there was no justification for the provision of land that was more than 34,000 times larger than the area of the property.
Given the violations of the law, the prosecutor’s office defended the interests of the state and filed a lawsuit to the court to ensure the efficient and rational use of natural resources and return the land to the community.
The court agreed with the prosecutor’s arguments and upheld the prosecutors’ appeal in full.
Upon receipt of the ruling, the prosecutor’s office will take measures to implement it.
