Under the procedural supervision of the Lviv Regional Prosecutor’s Office, a deputy of one of the village councils in Lviv region and five members of the organised group were served with a notice of suspicion. They are charged with abuse of office (Articles 27(2) and (3), 28(3), and 364(2) of the Criminal Code of Ukraine).
According to the investigation, the resident of Lviv region, while holding the position of the head of the land commission of the village council, organised the illegal allocation of land plots in favour of third parties. The land in question is located on the projected part of a road near Lviv. The road construction project envisages a transport interchange. Therefore, such land cannot be transferred to private ownership.
For this purpose, he involved three other employees of the same village council, as well as the director of a private land management organisation and the state registrar of one of the territorial communities of Lviv district.
The organiser found people from among his relatives who had the right to acquire land within the community free of charge. Then, without their knowledge, he applied to the village council with forged applications for permission to allocate land to them.
The accomplices from the village council approved these permits and, together with the organiser, ensured a positive vote of the village council commission on the allocation of these plots.
After that, the director of the private enterprise developed land management projects without the actual presence of the customers, and the state registrar registered the illegally registered land for agriculture.
As a result, three land plots with a total value of UAH 2.7 million were transferred out of communal ownership.
The investigation is ongoing. At the request of the prosecutor, the above plots were seized.
The pre-trial investigation is being conducted by investigators of the Territorial Department of the State Bureau of Investigation in Lviv city, with the operational support of the State Secret Service of Ukraine in Lviv region.
Note: In accordance with Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved in accordance with the law and established by a court verdict of guilty.
