Resident of Kyiv region to be tried for fictitious marriage for travelling abroad
Prosecutors of the Lviv Regional Prosecutor’s Office sent to court an indictment against a 43-year-old resident of Kyiv region for illegal trafficking of a person across the state border of Ukraine (Part 3 of Article 332 of the Criminal Code of Ukraine).
The investigation established that in May this year, the accused assisted a serviceman in illegal transfer across the state border by means of a fictitious marriage.
To do this, she, being a person with a group III disability, found a “client” in one of the Telegram groups who needed to leave Ukraine. Subsequently, the defendant arrived in Lviv, where she entered into a marriage with a serviceman who was interested in such a service.
In addition, the woman instructed the “client” on his behaviour during the border crossing, in particular to make it appear that their marriage was genuine. In the future, the man was to accompany the “wife” for treatment in the Republic of Poland.
The woman estimated her services at USD 5,000.
After payment, the accused was detained by law enforcement officers.
The pre-trial investigation was carried out by investigators of the Main Department of the National Police in Lviv region, with operational support provided by the 7th Border Guard Detachment of the State Border Guard Service of Ukraine and the Migration Police Department of the Main Department of the National Police in the region.
Note: In accordance with Article 62 of the Constitution of Ukraine, a person shall be presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
