Prosecutors defend fair sentence for man who raped child in appeal
Following the principled position of the prosecutors of the Frankivsk District Prosecutor’s Office of Lviv and the Lviv Regional Prosecutor’s Office, the court upheld the sentence of a man found guilty of raping a young boy (part 4 of Article 152 of the Criminal Code of Ukraine).
He was sentenced to 13 years in prison.
It was proved that in June 2020, the defendant committed sexual acts against a young boy.
At lunchtime, the man came to the playground and asked the children to help him repair his scooter. In return, he promised sweets. The 11-year-old boy agreed to help the stranger. Together, they went into the thicket, where the man took advantage of the victim’s minor age and helpless state and raped him. He then fled the scene.
The defence appealed against the verdict, requesting that the verdict be cancelled and the case be sent for a new trial. The Lviv Court of Appeal dismissed the appeal in its entirety and upheld the verdict of the court of first instance.
In addition, a decision was made to include information about the convicted person in the Unified Register of Persons Convicted of Crimes Against Sexual Freedom and Sexual Inviolability of Minors.
