An organized group of people who organized the illegal production and sale of ventilation systems, without having the right to use a patent, were exposed by the investigators of the department of investigation of crimes in the field of economic and official activities and operatives of the department for the protection of public and state interests of the police of the Lviv region under the procedural guidance of the Lviv regional prosecutor’s office.
As the law enforcement officers established during the pre-trial investigation, the director of the enterprise, a 42-year-old man from Lviv, not having the right to use a patent belonging to another legal entity, entered into a conspiracy with other criminals and organized the manufacture and sale of ventilation equipment systems in the territory of the Lviv region and abroad.
In this way, the right to use the patent was violated, and the right holder suffered material losses in the amount of about 2 million hryvnias.
On September 2, the perpetrator and accomplices were exposed by law enforcement officers during another illegal sale of products.
The investigators informed the director of the enterprise about the suspicion of committing criminal offenses provided for in Part 2 of Article 177 (Infringement of the rights to an invention, a utility model, an industrial design, the topography of an integrated microcircuit, a variety of plants, a rationalization proposal, committed repeatedly, or with a prior conspiracy by a group of persons, or which caused material damage in a large amount) of the Criminal Code of Ukraine and part 2 of article 15 – part 3 of article 177 (Attempt on the illegal use of a utility model, committed by an official using his official position or an organized group, or if they caused material damage damage in a particularly large amount) of the Criminal Code of Ukraine. The maximum punishment provided by the sanctions of the article is imprisonment for a term of up to six years, with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
A pre-trial investigation is ongoing. The activities of other criminals involved in the commission of offenses are being documented.
