Represented by prosecutors from the Lviv Regional Prosecutor’s Office, the Commercial Court upheld the claims of the Drohobych District Prosecutor’s Office to remove obstacles to the use of forestry land.
The land plots in question are those with a total area of over 13 hectares. They are located outside the settlement on the territory of the Nyzhnyohayiv village council of Drohobych district.
It was established that the Main Directorate of the StateGeoCadastre conducted an inventory. In the course of the inventory, part of the forestry land was unreasonably recorded as agricultural land. As a result, these plots were withdrawn from state ownership and transferred to municipal ownership.
Given the violation of the law, the prosecutor’s office filed a lawsuit with the court.
The court agreed with the prosecutor’s arguments and upheld the claim.
After the decision enters into force, the state registration of land plots in the State Land Cadastre will be terminated.
