The Lviv District Administrative Court opened proceedings against the lawsuit of the Frankiv District Prosecutor’s Office of the city of Lviv. Prosecutors demand to oblige a natural person to conclude a security agreement for the object of cultural heritage – “Villa of Aleksander Kshechunovych”.
The indicated architectural monument of local importance is located on one of the streets of the city of Lviv and is privately owned by the defendant.
According to the current legislation, owners of monuments of newly discovered cultural heritage objects, regardless of the forms of ownership of these objects, are obliged to conclude the above-mentioned agreement for the purpose of their preservation.
However, the owner of the apartment violated the law and for a long time did not conclude a security agreement with the authorized body.
Therefore, this became the basis for filing a lawsuit in court.
In addition, we note that the court has opened proceedings based on a similar claim by the district prosecutor’s office against a private enterprise, which is also the owner of another apartment in the above-mentioned building.
The trial is currently ongoing.
