The prosecutors of the Lviv Regional Prosecutor’s Office sent an indictment to the court against two employees of the utility company, the director of the company and the chief design engineer for taking possession of someone else’s property (Part 4 of Article 191 of the Criminal Code of Ukraine). The last two were also charged with official forgery of official documents (Part 1 of Article 366 of the Criminal Code of Ukraine).
The investigation established that a contractual agreement was concluded between the utility company and the international consortium for the construction of a biogas plant with combined production of electricity and thermal energy in Lviv. According to the terms of the latter, the customer was obliged to dismantle the existing facilities on the territory of sewage treatment facilities.
However, one of them is a workshop, garage, and warehouse building with a total area of 432 square meters. m. was demolished at that time. Therefore, there was no need to dismantle it.
Despite this, in order to obtain illegal profit, the defendants created documentary grounds for dismantling. In the official documents: design and estimate documentation, acts of acceptance of completed construction works and certificates of their cost, false information about their alleged implementation was reflected.
In this way, more than UAH 400,000 was unjustifiably transferred to the business entity.
The pre-trial investigation in the criminal proceedings was carried out by the investigators of the Main Department of the National Police in the Lviv region.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
