The prosecutors of the Lviv Regional Prosecutor’s Office ensured participation in the review by the Lviv Court of Appeal of the appeal against the decision of the court of first instance, by which the head of the communal enterprise of the regional council was found guilty of violating the procedure for the prevention and settlement of conflicts of interest (Part 1, 2 of Article 172-7 of the Code of Administrative Offenses).
The prosecutors proved that the head of one of the enterprises of the Lviv Region did not report the existence of a real conflict of interests and made a decision under the conditions of the conflict to approve acts of acceptance of legal services provided to the enterprise by his son.
Namely, implementation of legal support, legal support of business activities, provision of legal consultations, preparation of legal documents, for these services the son of the chief was paid money in the amount of UAH 360,000.
Thus, the court found the man guilty of a conflict of interest and imposed a penalty on him in the form of a fine with deprivation of the right to hold positions and engage in activities related to the performance of organizational and managerial and administrative and economic functions at enterprises, institutions, organizations of all forms of ownership for a period of time for one year.
Accordingly, the appellate court rejected the person’s appeal against the decision of the court of first instance, and the court’s decision remained unchanged.
The prosecutor submitted a submission to the subject of the appointment to conduct an official investigation in order to identify the reasons and conditions that contributed to the commission of a corruption or corruption-related offense.
And the question of taking measures of a civil legal nature to eliminate the consequences of offenses related to corruption is also resolved.
