Lawyer in Drohobych Promised to Avoid Mobilization for $14,000

In Drohobych, a former judge, currently a practicing lawyer, was detained for promising a client to help avoid mobilization for $14,000. Under the procedural guidance of the Lviv Regional Prosecutor’s Office, the lawyer was exposed and notified of suspicion. He is accused of receiving an improper benefit for himself for influencing the decision-making of a person authorized to perform state functions, combined with extortion of such a benefit (part 3 of article 369-2 of the Criminal Code of Ukraine).

Scheme to Avoid Mobilization

According to the investigation, the lawyer assured the conscript that for a monetary reward he could solve the issue of avoiding mobilization. The lawyer promised to influence a judge to make a positive decision regarding the dissolution of the marriage between a man and his wife, and the determination of the place of residence of their minor child with the father. In addition, the woman would be deprived of parental rights and he would become the sole guardian of the child. Thus, this would be the basis for the client to obtain the right to deferment from conscription for military service during the martial law in Ukraine.

The price of such a service is $14,000. The suspect was detained under Article 208 of the Criminal Procedure Code of Ukraine while receiving part of the improper benefit amounting to $7,000. Investigative actions are ongoing. Pre-trial investigation in the criminal proceeding is carried out by investigators of the Main Department of the National Police of the region based on the materials of the Security Service of Ukraine in Lviv region.

Note: According to Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a legal proceeding and established by a court conviction.
